Emotional pain would be too hard to prove. There are no tests for emotional pain. There is no evidence like a punch in the face would leave.

There are many issues that you raise in your question, but it seems that no matter what anyone thinks about what is and isn’t illegal and what should be…making emotional harm illegal with all the legal wranglings that go along with that. It would seem to be nearly impossible to prove, and therefore ripe for abuse, manipulation and fraud. Can you imagine what that courtroom would be like?
Simple: Physical injury can be seen, but emotional injury can’t. If you can’t see it, can you prove it? Remember, judges don’t care about what you know; they only care about what you can prove.
P.S.: For all you folks out there that believe the military does things backwards, cheating on your spouse IS illegal in the U.S. Armed Forces. Adultery is a court-martial punishable offense under Article 134 of the Uniform Code of Military Justice.

Because you can prove physical harm, emotional harm is much more difficult to establish. And if that were the case we’d have crazy people running around filing suit against everyone for looking at them wrong.

My ex wife cheated on me. I wanted to pound her good after everything I went through for and with her. She definitely would have deserved it.
